General conditions of sale
Shipping costs will be calculated automatically by our online web shop system and will be displayed before you place your order.
The various factors to consider are:
• the quantity of items
• the delivery address
Please inquire with your Customs’ Authorities if there may be additional costs such as customs duties, taxes or import service charges, these costs that will remain under responsibility of the buyer.
For the territories of Canada, the United States of America, South Africa and Brazil, transportation capacities are still considerably reduced due to Covid-19 pandemic impact. This may result in longer delivery times of at least between 20-30 days.
For Australia and New Zealand, the delivery time is at least between 40-50 days!
For mainland China, Hong Kong SAR, Japan, Taiwan and Thailand, transit times are longer by at least 20-30 days due to interrupted flight connections and overflight bans!
The pictures representing the products have only an indicative value because of the alterations that may exist due to their transcription on the site.
Except in the case of a guarantee, any delivery claim made between CX AIR DYNAMICS and its customers, not disputed within 14 days of delivery, cannot give rise to a claim.
3. Customer information: Order data saving
We save your order including details of the contract concluded (e.g., type of product, price, etc.). We send you the terms and conditions.
However, you can consult them at any time, even once the contract has been concluded online through our website.
As a registered customer, you can access your previous orders via the customer area (“My customer account” section).
4. Customer Information: Changes
You can modify your cart and correct your entries at any time before ordering by using the “Delete” button. We will inform you during the ordering process about further possibilities for corrections and amendments. You can also completely suspend the ordering process by closing the browser window.
5. Retention of title
(1) We reserve the ownership of the delivered goods until the full payment for the goods is effective. During this retention of title, the buyer may not sell the goods (hereinafter: reserved goods) or dispose of its property.
(2) In the event of intervention by third parties, in particular a bailiff, on the reserved goods, the buyer shall state the name of the owner and contact us immediately, so that we can assert our rights.
(3) In the event of unlawful behavior on the part of the purchaser, and in particular in the event of late payment, we are entitled to demand the return of the reserved goods, provided that we have withdrawn from the contract.
6. Warranty claims in the case of defects
Warranty rights in the case of defects shall apply to our goods.
Prescription
Your rights in the event of defects in used articles expire after one year from the handover of the sold goods. Excluded from this regulation are claims for damages, rights in the event of defects that we have fraudulently concealed and warranty rights that we assume on the quality of the goods. The statutory limitation periods apply for these exceptions.
7. Limitation of Liability
We assume no liability for minor breaches of our obligations, insofar as these are not essential contractual obligations, damage to life, body or health, warranties or claims according to the product liability law. The same applies to minor breaches by our assistants or legal representatives. Among the essential contractual obligations is the obligation to hand over the object to you and to obtain ownership of it. Furthermore, we are obliged to provide you with the object free from material and legal defects.
8. Damage in transit
At the time of receipt of the products at destination, the Customer must check the integrity of the packages and the quantitative and qualitative correspondence of the products ordered.
In the event of discrepancies and/or disparities, the Customer must report and have these noted to the carrier, and in the event that the package or packaging of the products ordered by the Customer arrive at their destination clearly damaged, the Customer is invited to refuse the delivery made by the carrier or accept delivery “with reservation”.
10. Terms of Payment
By credit card
Payment is made on the secure banking server of our banking partner.
This implies that no banking information concerning you goes through our website.
Payment by credit card is therefore perfectly secure; your order will thus be registered and validated as soon as the payment is accepted by the bank.
Your payment by credit card will be likely to be verified and authenticated in order to fight against identity theft and the fraudulent use of means of payment.
Payment is made directly to the CX AIR DYNAMICS bank, which has no access to your details, and does not keep them on its servers.
This is the reason why they are requested from you with each new transaction on our site.
By bank check
Your order is then booked for 7 days.
Beyond this period, without receipt of your check, it will be canceled.
The order will only be processed upon receipt of your check and after validation.
Your order will only be shipped after receipt of your check.
By PayPal
Your payments are made directly on the PayPal site via encrypted pages using the SSL (Secure Socket Layer) protocol.
CX AIR DYNAMICS has no access to your bank details.
Securing
Your credit card details are encrypted using the SSL (Secure Socket Layer) protocol and are never transmitted unencrypted over the network.
Title retention clause
The products remain the property of CX AIR DYNAMICS until full payment of the order.
However, from the time of delivery, the risks of the delivered goods are transferred to the customer.
Default of payment
CX AIR DYNAMICS reserves the right to refuse to process a delivery or to honor an order from a consumer who has not fully, or partially paid a previous order or with whom a payment dispute is in progress.
11. Terms
The delivery of the products purchased by the Customer will be made by the seller to the shipping address indicated by the Customer.
Each shipment contains:
– the product(s) ordered;
– the related invoice issued by the Seller, if the Customer is based outside the European Union.
CX AIR DYNAMICS undertakes to comply as much as possible with the shipping date and ETA (Estimated Time of Arrival) given to you as an indication on the order confirmation email.
Shipments to the Customer are made using selected shipping companies and carriers.
As an indication – but in all cases without this committing the Seller and without prejudice to the effective availability of the Products, the products ordered will be delivered by the Seller to the selected carrier within two working days from the acceptance of the order.
In any case, the delivery will be made within a maximum of 30 (thirty) days starting from the day following the transmission of the order by the Buyer.
In the event partial availability of the products, occurring at the confirmation of the order, the Seller will inform the Customer without delay and, only upon his approval, the Seller shall undertake to process the order according to the products’ availability.
At the time of receipt of the products at destination, the Customer must check the integrity of the packages and the quantitative and qualitative correspondence of the products ordered.
In the event of discrepancies and/or missing items, the Customer must report and have these noted by the carrier, and in the event that the package or packaging of the products ordered by the Customer arrive at their destination clearly damaged, the Customer is invited to refuse delivery made by the carrier/shipper or accept delivery “with reservation”.
The purchased products will be delivered by the carrier hired by the seller on behalf of the seller to the shipping address indicated by the Customer.
In respect of the shipping of your order, the handling of your package, when carried out by the Company “Colissimo”, the shipping date may vary depending on your method of payment (verification of the bank card, time limit for receipt of your check).
For other countries, delivery costs will depend on the destination.
All packages are shipped from Monday to Friday and a tracking number will be systematically communicated to you upon shipment.
No compensation may be claimed if an item cannot be delivered: either following an unforeseen stoppage of production, or following strikes, accidents, natural disasters, impossibility of obtaining supplies or any other causes beyond our control.
The withdrawal period is 14 days for non-professionals, the transport and return costs remaining the responsibility of the buyer.
